He got behind the wheel because he believed his elderly mother had fallen and needed help. He knew he should not drive, but in that moment, fear for a loved one overrode clear thinking.

Scott describes it simply: “There was a reason he did what he thought he had to do in that moment, and that's the human reason he did it.”

The human element the State does not see

The State Attorney’s Office usually receives only the bare facts: the charge, the statutes, the officer’s narrative. As Scott notes in the video, “They get the police report, and it's not anybody's fault. But that's just how it's reported is just what happened.” The system sees an incident. We see a person in the middle of that incident.

In this case, the client had been doing well on felony probation. He had stayed sober and changed the direction of his life.
