How We Approach a Jacksonville Beach BUI Defense
A BUI defense starts with the stop itself. Under the Boater Freedom Act, an officer must have probable cause of a violation before detaining a vessel. If that threshold wasn’t met, whether the stop occurred on the Intracoastal Waterway or closer to shore, the evidence gathered afterward may be challengeable. We examine the circumstances of each stop before evaluating anything else.
Field Sobriety Exercises on the Water
Field sobriety exercises present a separate issue in BUI cases. The standardized exercises used in roadside DUI stops were designed for stable, dry ground. On a rocking boat deck, balance and coordination are affected by the vessel itself, not necessarily by impairment. Officers sometimes conduct these exercises aboard or bring a boater to shore before testing. Either way, the conditions under which the exercises were performed matter to how we evaluate the results.
