BUI Penalties Under Florida Law

The consequences of a BUI conviction escalate with each prior offense and with aggravating factors. Here is what the statute provides at each tier:

  • First offense (second-degree misdemeanor): Fine of $500 to $1,000, up to six months in jail, mandatory probation, 50 hours of community service, and 10-day vessel impoundment.
  • Second offense: Fine up to $1,000, up to nine months in jail. If it occurs within five years of the first conviction, a mandatory minimum of 10 days in jail applies, plus 30-day vessel impoundment.
  • Third offense within 10 years (third-degree felony): Up to five years in prison, a $2,000 to $5,000 fine, a mandatory minimum of 30 days in jail, and 90-day vessel impoundment.
  • Aggravating factors: A BAC of 0.15% or higher, a passenger under 18, or an accident causing property damage, injury, or death increases penalties at every tier and can elevate a charge to BUI manslaughter, a felony.
  • Breath test refusal: Refusing a lawful breath, blood, or urine test after a BUI stop carries separate penalties under Florida’s boating implied consent law.
